  WHAT IS A PATENT ?

It is a right of priviledge granted to the owner for an invention in a field of technology and with an application to a patent in order to produce and use the product which is the subject of the patent.

CAN I OBTAIN A PATENT FOR EVERY INVENTION ?

Patent protection in our country is provided for according to the provision of Statutory Decree on Protection of Patent Rights 551. Patent granting criteria and the innovations to be patented are specified. The following three criteria are required to patent an invention:

  • Innovation : It should be new and never used in Turkey and in the world and it should not have been published in any magazine, bulletin, etc.
  • Applicability in industry: It should not be only theoretical, but it should also be applicable.
  • Exceeding the known state of the technique: It should raise that technology to a higher level.

 

WHY WE OBTAIN PATENTS ?

Application of innovations and inventions is very important for the economic development of the nations. We need to apply the innovations and inventions and as a result, to reward the most effective ones on contributing to the economy and to encourage such inventions. Patenting is a system which provides the owner of an invention with priviledges for a certain time in selling and using the patent – subject product, which encourages such inventions, which contributes to the development of the economy and which is recognized and applied in all the developed countries. For this reason, if we do not want our invention to be imitated and used by others who would become our competitors, we should make an application to obtain a patent.

PATENT

Invention certificate or patent is an official certificate and title which provides the owner with priviledges in selling, marketing, reproducing, producing duplicates of the product invented.

Patenting a new product is generally conducted by government organizations or autonomous organizations which generally consider some agreements among states. Though the conditions change from market to market, the product should contain an innovation, a significant difference compared to the previous one and it should be more than an ordinary rearrangement in the view of an expert in the field of the patented product.

The most common patenting way is to restrict completely the production of another product in the same structure with the patented product for a certain period of time or to leave it to the approval of the patent owner.
